Many DSCR programs allow the loan to close in an LLC, which is one of the main reasons investors choose them. Lenders usually require the entity documents and a personal guarantee from the owner, and the property insurance and title must match the borrowing entity. We are not attorneys, so ask a North Carolina or South Carolina attorney or CPA how to structure ownership.
Why investors use an LLC
Investors often hold rentals in an LLC to separate property ownership from personal assets and to organize multiple properties. Conventional investment loans generally must close in an individual's name, while many DSCR programs allow an entity. Whether an LLC is right for you is a legal and tax question, not a lending one.
What the lender usually asks for
- Articles of organization and operating agreement
- EIN letter
- Certificate of good standing from the state
- A list of members and their ownership percentages
- A personal guarantee from the principal owner on most programs
- Credit and assets for the guarantor, since personal credit is still reviewed
Details that trip up closings
- Insurance. The policy should name the entity as the insured, with the lender as mortgagee.
- Title and deed. Vesting in the entity should be set up with your attorney before closing.
- Newly formed LLCs. Some lenders want the entity in good standing for a period, so form it early.
- Bank accounts. Some programs want funds to come from the entity or the guarantor, with a paper trail.
Other things to confirm
- Transfers into an LLC after you buy can trigger due-on-sale clauses on a loan, so talk to your lender and attorney first.
- Closing in North Carolina and South Carolina runs through an attorney, so choose one who handles entity vesting.
